Introduction

Thank you for using CasaVanguardia. These Terms of Service (“Terms”) govern your access to and use of the website casavanguardia.co and all related services (together, “the Service”) operated by Far Horizons OÜ.

When we say “Company”, “we”, “our”, or “us” in this document, we are referring to Far Horizons OÜ, an Estonian private limited company (Osaühing) with registered address at Sepapaja 6, 15551 Tallinn, Estonia.

When we say “you” or “your”, we are referring to you as an individual user of the Service.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

We may update these Terms in the future. Whenever we make a significant change, we will post a notice on the Website and, where possible, notify registered users by email. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms. These Terms contain a limitation of our liability — please read them carefully.

Description of the Service

CasaVanguardia is a property search portal that aggregates publicly available real estate listings from various sources across Spain. The Service provides:

• Property search and filtering tools
• Listing detail pages with photos, descriptions, and pricing
• Inquiry forms to contact estate agents or property owners
• Saved searches and favourite listings (for registered users)
• Map-based property exploration

CasaVanguardia is not a real estate agency, broker, or intermediary. We do not buy, sell, rent, or manage properties. We do not participate in or facilitate property transactions. We do not provide real estate advice, legal advice, financial advice, or valuations. Any transaction you enter into with a property agent or owner is solely between you and that party.

Eligibility and Account Terms

1. You must be at least 16 years of age to use the Service. By using the Service, you represent that you meet this requirement.
2. You may browse the Service without creating an account. Certain features — such as saving favourites and submitting inquiries — require you to create an account.
3. Accounts are created and managed through our authentication provider, Clerk. You are responsible for maintaining the security of your account credentials. The Company cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
4. You are responsible for all activity that occurs under your account.
5. You must be a human. Accounts registered by automated methods (“bots”) are not permitted.
6. You may only maintain one account. Creating multiple accounts to circumvent restrictions or for deceptive purposes will result in termination of all associated accounts.

Acceptable Use

You agree to use the Service only for its intended purpose — finding and learning about property listings — and in compliance with all applicable laws. You must not:

• Scrape or harvest data from the Service using automated tools, bots, crawlers, or similar technology without our prior written consent.
• Submit false or misleading inquiries to estate agents or property owners through the Service.
• Harass, threaten, or abuse estate agents, property owners, other users, or Company personnel through the Service.
• Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
• Distribute spam, chain letters, or unsolicited communications through the Service.
• Upload or transmit malicious code, viruses, or any material that could disrupt the Service.
• Attempt to gain unauthorised access to any part of the Service, other users’ accounts, or our systems.
• Use the Service for any unlawful purpose, including fraud, money laundering, or violating sanctions regulations.
• Reproduce, duplicate, copy, sell, or resell any portion of the Service without express written permission.

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you have violated these acceptable use requirements.

Listing Accuracy and Disclaimer

This is important — please read it carefully.

CasaVanguardia aggregates property listing data from publicly available third-party sources. We do not create, verify, endorse, or guarantee the accuracy of any listing information displayed on the Service, including but not limited to:

• Property prices and currency
• Property descriptions and specifications (size, rooms, features)
• Photographs and virtual tours
• Location data and maps
• Agent or owner contact details
• Availability or legal status of properties
• Compliance with local planning or building regulations

Listings may be outdated, inaccurate, incomplete, or no longer available. Prices displayed may not reflect the current asking price and may exclude taxes, fees, or other costs. Property photographs may not accurately represent the current condition of a property.

You must independently verify all property information before making any decisions, including by conducting your own due diligence, engaging qualified professionals (surveyors, lawyers, financial advisers), and visiting properties in person.

CasaVanguardia is a search tool, not a source of truth. We are not liable for any loss or damage arising from reliance on listing information displayed on the Service.

Intellectual Property

Our Content

The Service — including its design, layout, code, branding, logos, and original content — is owned by Far Horizons OÜ and protected by Estonian, EU, and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of our content without our prior written consent.

Listing Content

Property listing data displayed on the Service originates from third-party sources. Intellectual property rights in individual listing content (descriptions, photographs, etc.) remain with their respective owners. CasaVanguardia’s selection, arrangement, and presentation of aggregated listing data constitutes a compilation protected under applicable database rights and copyright laws.

Your Content

If you submit content to the Service — such as reviews, comments, or uploaded images — you retain ownership of that content. However, by submitting it, you grant Far Horizons OÜ a worldwide, non-exclusive, royalty-free, transferable licence to use, reproduce, modify, display, and distribute that content in connection with operating and promoting the Service. You represent that you have the right to grant this licence and that your content does not infringe any third party’s rights.

Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

Limitation of Liability

The Service is provided on an “as is” and “as available” basis, without warranties of any kind, either express or implied.

To the maximum extent permitted by applicable law, Far Horizons OÜ shall not be liable to you or any third party for any direct, indirect, incidental, special, consequential, or punitive damages — including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses — arising from or in connection with:

1. Your use of or inability to use the Service;
2. Any listing information displayed on the Service, including inaccurate, misleading, or outdated information;
3. Any property transaction you enter into as a result of using the Service;
4. Any interaction between you and an estate agent, property owner, or other third party contacted through the Service;
5. Unauthorised access to or alteration of your data;
6. Any interruption, suspension, or discontinuation of the Service;
7. Any other matter relating to the Service.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law (including mandatory EU consumer protection rules).

Where our liability is not excluded, our total aggregate liability to you for all claims arising from or in connection with the Service shall not exceed EUR 100.

Indemnification

You agree to indemnify and hold harmless Far Horizons OÜ, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any third party’s rights.

Termination

1. You may stop using the Service at any time. You can delete your account through your account settings or by contacting us at hello@farhorizons.io.
2. We reserve the right to suspend or terminate your account and access to the Service at any time, for any reason, including violation of these Terms. We will make reasonable efforts to notify you in advance where possible, but this is not always practicable (e.g. in cases of abuse or security concerns).
3. Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.
4. Provisions of these Terms that by their nature should survive termination — including intellectual property, limitation of liability, indemnification, and governing law — shall survive.

Modifications to the Service

We are continually developing and improving the Service. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

Where mandatory consumer protection legislation of the European Union or your country of habitual residence provides more favourable protections, those protections shall apply to the extent required by law.

Any disputes arising from or in connection with these Terms or the Service shall be submitted to the competent courts of Tallinn, Estonia, unless mandatory consumer protection legislation grants you the right to bring proceedings in the courts of your habitual residence.

Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions remain in full force and effect.

Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and Legal Notice, constitute the entire agreement between you and Far Horizons OÜ regarding your use of the Service.
