Agent & Agency Terms of Service

Introduction

These Agent & Agency Terms of Service (“Agent Terms”) govern the use of CasaVanguardia’s listing management and lead generation services by licensed real estate professionals, agencies, and their authorised representatives (“you”, “Agent”, or “Agency”). These Agent Terms supplement the general Terms of Service applicable to all users of casavanguardia.co (“the Platform”), operated by Far Horizons OÜ (“the Company”, “we”, “us”).

By creating an Agent or Agency account, you confirm that you have read, understood, and agree to be bound by these Agent Terms, our general Terms of Service, and our Privacy Policy.

Eligibility and Acceptance

To register as an Agent or Agency on CasaVanguardia, you must:

  1. Be a licensed or legally authorised real estate professional in the jurisdiction(s) where you operate, or be an employee or authorised representative of such a professional or agency.
  2. Provide accurate and verifiable business information, including your trading name, licence or registration number (where applicable), registered address, and contact details.
  3. Be at least 18 years of age and have the legal authority to enter into binding agreements.
  4. Maintain all licences, registrations, and professional insurances required by the laws of the jurisdictions in which you operate throughout the duration of your use of the Platform.

We reserve the right to verify your credentials at any time and to suspend or terminate your account if we reasonably believe you do not meet these eligibility requirements.

Subscription Terms and Billing

Plans and Features

CasaVanguardia offers subscription plans with varying levels of features, listing allowances, and lead management capabilities. Details of available plans, pricing, and included features are published on the Platform and may be updated from time to time.

Billing via Stripe

All subscription payments are processed through Stripe. By subscribing to a paid plan, you agree to Stripe’s terms of service in addition to these Agent Terms. You authorise us to charge your designated payment method for the applicable subscription fees.

Billing Cycle and Auto-Renewal

Subscriptions are billed on a recurring basis (monthly or annually, depending on your selected plan). Your subscription will automatically renew at the end of each billing period unless you cancel before the renewal date. We will charge the payment method on file at the then-current subscription rate.

Plan Changes

  • Upgrades take effect immediately. You will be charged a prorated amount for the remainder of the current billing period.
  • Downgrades take effect at the start of the next billing period. You retain access to higher-tier features until then.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. No further charges will be made after cancellation, but fees already paid are non-refundable except as described in the Refund Policy section below.

Late and Failed Payments

If a payment fails, we will make reasonable attempts to collect. If payment remains outstanding for more than 14 days, we may suspend your account and delist your active listings. Your listings will be restored once payment is received.

Refund Policy

Refunds for Agent subscriptions are handled in accordance with our general refund policy. In summary:

  • If you were charged for a renewal you intended to cancel, contact us within 14 days and we will refund the charge.
  • If you are within the first 14 days of a new subscription and have not received material value from the service, you may request a full refund.
  • Partial refunds or account credits may be considered on a case-by-case basis for service disruptions or billing errors.

To request a refund, email hello@farhorizons.io with your account details and the reason for your request.

Listing Content Guidelines

Accuracy and Completeness

All listing content you submit must be accurate, up to date, and not misleading. You are responsible for ensuring that:

  • Property descriptions truthfully represent the property’s condition, features, and legal status.
  • Listed prices reflect the actual asking price or price range for the property.
  • Property availability is kept current — sold, let, or withdrawn properties must be removed or marked accordingly within a reasonable timeframe.
  • Location data is accurate and does not misrepresent the property’s position.

Prohibited Content

You must not submit listings or associated content that:

  • Contain false, misleading, or deceptive information about a property.
  • Infringe the intellectual property rights of any third party.
  • Include discriminatory language or content that violates anti-discrimination laws.
  • Advertise properties you are not authorised to market.
  • Contain malware, phishing links, or any form of malicious code.
  • Include excessive or irrelevant keywords intended to manipulate search results.
  • Violate any applicable real estate advertising regulations.

We reserve the right to remove any listing that violates these guidelines, with or without prior notice. Repeated violations may result in account suspension or termination.

Media Usage Rights

Licence Grant

By uploading photographs, floor plans, videos, virtual tours, or other media (“Media”) to CasaVanguardia, you grant us a non-exclusive, worldwide, royalty-free licence to display, reproduce, distribute, and create derivative works of such Media for the purpose of operating and promoting the Platform and the relevant listings. This licence continues for the duration of your subscription and for a reasonable wind-down period (up to 90 days) after listing removal or account termination.

Your Warranties

You represent and warrant that:

  • You own or have obtained all necessary rights, licences, and permissions to upload and licence the Media.
  • The Media does not infringe the intellectual property, privacy, or other rights of any third party.
  • You have obtained any required consents from individuals depicted in the Media, in accordance with applicable data protection laws including the GDPR.

Our Use

We may resize, crop, watermark, compress, or otherwise adapt Media for display purposes across different devices and formats. We will not sell your Media to third parties as standalone content, nor use it for purposes unrelated to the Platform without your consent.

Watermark and Branding

CasaVanguardia may apply a watermark or branding overlay to listing images displayed on the Platform to prevent unauthorised reproduction. You agree not to remove, obscure, or modify any CasaVanguardia watermarks or branding applied to content displayed on the Platform.

You may not use the CasaVanguardia name, logo, or branding in your own marketing materials without our prior written consent. We may provide co-branded materials or badges for use by Agents in good standing, subject to separate brand guidelines.

Lead and Inquiry Handling

Response Obligations

When a user submits an inquiry about one of your listings through CasaVanguardia, you are expected to:

  • Acknowledge the inquiry within 48 hours.
  • Provide accurate and helpful information in response.
  • Conduct yourself professionally and in accordance with applicable professional standards.

Data Protection for Inquiry Data — Joint Controller Arrangement

When a user submits an inquiry about one of your listings through CasaVanguardia, both CasaVanguardia and you (the receiving Agent or Agency) act as joint controllers of that inquiry data under GDPR Article 26. The essence of this arrangement is set out in our Joint Controller Agreement.

In summary, CasaVanguardia is responsible for collecting, storing, and transmitting inquiry data, and for providing data subjects with a means to exercise their rights. You, as the receiving Agent or Agency, are responsible for:

  • Processing inquiry data only for the purpose of responding to the property inquiry and any directly related follow-up.
  • Not using inquiry data for unrelated marketing without obtaining the individual’s separate, freely given consent.
  • Implementing appropriate technical and organisational measures to protect inquiry data.
  • Cooperating with CasaVanguardia on data subject rights requests (access, deletion, rectification) within 5 business days.
  • Notifying us at privacy@farhorizons.io without undue delay if you become aware of a data breach affecting inquiry data received through CasaVanguardia.

By using the CasaVanguardia platform, you agree to the Joint Controller Agreement regarding inquiry data processing.

Failure to handle inquiry data in compliance with the GDPR, the Joint Controller Agreement, and these Agent Terms may result in suspension or termination of your account.

Your Obligations

As an Agent or Agency on CasaVanguardia, you agree to:

  1. Comply with all applicable laws and regulations in the jurisdictions where you operate, including real estate licensing laws, consumer protection regulations, anti-money laundering requirements, and data protection legislation.
  2. Maintain accurate account and business information and notify us of any material changes.
  3. Not engage in any activity that could damage the reputation or operation of CasaVanguardia.
  4. Not attempt to circumvent Platform features, scrape data, or interfere with other users’ accounts.
  5. Not create multiple accounts to circumvent plan limitations or disciplinary actions.

Platform Availability and SLA

CasaVanguardia is provided on a best-effort basis. We aim to maintain high availability but do not guarantee uninterrupted service. Specifically:

  • We target 99.5% monthly uptime for the Platform but this is an objective, not a contractual guarantee.
  • Scheduled maintenance windows will be communicated in advance where practicable.
  • We are not liable for downtime caused by factors outside our reasonable control, including internet disruptions, third-party service failures, or force majeure events.
  • Service status updates are available at our status page.

Termination

Termination by You

You may terminate your account at any time by cancelling your subscription and contacting us at hello@farhorizons.io. Upon termination:

  • Your active listings will be delisted within 7 days.
  • Your account data will be retained for 30 days to allow for reactivation, after which it will be deleted in accordance with our Privacy Policy.

Termination by Us

We may suspend or terminate your account immediately if:

  • You breach these Agent Terms or our general Terms of Service.
  • We reasonably believe your listings contain fraudulent, misleading, or illegal content.
  • Your account is used for activities that harm the Platform or other users.
  • You fail to make payment after reasonable notice.
  • Required by law or regulatory order.

We will make reasonable efforts to notify you of termination and the reasons for it, unless we are legally prevented from doing so.

Data Portability

Upon request made within 30 days of account termination, we will provide you with an export of your listing data (text content and metadata) in a standard machine-readable format. Media files can be downloaded from your account prior to termination. After the 30-day period, we are under no obligation to retain or provide your data.

Limitation of Liability

To the maximum extent permitted by applicable law:

  • CasaVanguardia is provided “as is” and “as available”. We make no warranties, express or implied, regarding the Platform’s fitness for a particular purpose, reliability, or availability.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to loss of revenue, loss of business opportunities, or loss of data.
  • Our total aggregate liability to you for any claims arising from or related to these Agent Terms shall not exceed the total fees you paid to us in the 12 months preceding the claim.
  • We are not a party to any transaction between you and property buyers, sellers, tenants, or landlords, and bear no liability for the outcome of such transactions.
  • We do not verify the identity, financial status, or intentions of users who submit inquiries through the Platform.

Nothing in these Agent Terms limits or excludes our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited or excluded under applicable law.

Indemnification

You agree to indemnify, defend, and hold harmless Far Horizons OÜ, its directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:

  • Your breach of these Agent Terms.
  • Your listing content or Media.
  • Your handling of user inquiry data.
  • Any violation of applicable law in connection with your use of the Platform.

Changes to These Terms

We may update these Agent Terms from time to time. We will notify you of material changes by email or through the Platform at least 30 days before they take effect. Your continued use of the Platform after the effective date of any changes constitutes acceptance of the updated terms.

Governing Law and Dispute Resolution

These Agent Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.

Any disputes arising from or in connection with these Agent Terms shall be submitted to the competent courts of Tallinn, Estonia. Where you are established in the EU and mandatory consumer or business protection rules of your jurisdiction provide more favourable protections, those rules shall apply to the extent required by law.

Before commencing legal proceedings, both parties agree to attempt to resolve any dispute through good-faith negotiation for a period of at least 30 days.
