Overview
Far Horizons OÜ (“the Company”, “we”, “us”) respects intellectual property rights and expects all users of CasaVanguardia to do the same. This page describes how we handle copyright infringement claims related to content displayed on casavanguardia.co (“the Platform”).
CasaVanguardia is a property search portal that aggregates publicly available real estate listings from various sources. Some listing content — including property descriptions, photographs, and floor plans — may originate from third-party sources such as real estate agencies, MLS systems, and publicly accessible listing portals. While we endeavour to display content in a manner consistent with applicable copyright exceptions (including the EU Database Directive and fair dealing provisions), we recognise that aggregation may occasionally result in the display of content in ways not authorised by the rights holder.
If you believe your copyrighted work has been reproduced on CasaVanguardia without authorisation, this policy explains how to notify us and what to expect.
Notification of Copyright Infringement
If you are a copyright owner (or authorised to act on behalf of one) and believe that content on CasaVanguardia infringes your copyright, you may submit a takedown notification. To be effective under the Digital Millennium Copyright Act (17 U.S.C. Section 512) and equivalent provisions under EU and Estonian law, your notification must be in writing and include the following:
Signature. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf.
Identification of the copyrighted work. A description of the copyrighted work(s) you claim have been infringed. If multiple works are affected, you may provide a representative list.
Location of infringing material. Information reasonably sufficient to permit us to locate the material on the Platform — ideally a URL or set of URLs where the content appears.
Your contact information. Your name, mailing address, telephone number, and email address so that we can contact you regarding the claim.
Good faith statement. A statement that you have a good faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law.
Accuracy and authority statement. A statement, made under penalty of perjury, that the information in your notification is accurate and that you are the copyright owner or are authorised to act on behalf of the copyright owner.
Important: Knowingly submitting a materially false takedown notice may expose you to liability for damages, including costs and legal fees.
What Happens After We Receive a Notification
Upon receiving a valid copyright infringement notification, we will:
- Acknowledge receipt of your notification, typically within 2 business days.
- Investigate the claim and identify the material in question.
- If the claim appears valid, promptly remove or disable access to the allegedly infringing material.
- Notify the user or content provider (if identifiable) that the material has been removed.
- Retain a copy of the notification in our records.
Counter-Notification
If you believe that material removed from CasaVanguardia was removed in error or that you have authorisation to use it, you may submit a written counter-notification. Your counter-notification must include:
Signature. Your physical or electronic signature.
Identification of removed material. A description of the material that was removed and the URL or location where it appeared before removal.
Statement under penalty of perjury. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
Consent to jurisdiction. A statement that you consent to the jurisdiction of the courts of Tallinn, Estonia, or, if you are located outside Estonia, that you consent to the jurisdiction of any judicial district in which Far Horizons OÜ may be found, and that you will accept service of process from the person who filed the original infringement notification (or their agent).
Your contact information. Your name, address, telephone number, and email address.
Upon receiving a valid counter-notification, we will forward it to the original complainant and inform them that the removed material may be restored in 10 business days. If the original complainant does not notify us that they have filed a court action seeking to restrain the allegedly infringing activity within that period, we may restore the material.
Property Photography — Specific Guidance
Property portals commonly display photographs taken by professional photographers who retain copyright in their images, even when the photographs were commissioned by a real estate agent or property owner. We recognise this as a frequent and legitimate concern.
If you are a property photographer whose images appear on CasaVanguardia without your consent:
- Please include the specific URLs where your images appear in your notification.
- Where possible, provide evidence of your ownership (e.g. original files with EXIF data, your watermark, or a link to the images on your own website or portfolio).
- If you have licensed the images to a specific agent or agency, please indicate whether the issue is with the images appearing on CasaVanguardia specifically, or with their use by the agent beyond the scope of the licence.
If you are a real estate agent who uploaded images to CasaVanguardia:
- Ensure you have the right to use and sublicence all images you upload. A licence to use photographs on your own website may not extend to third-party platforms.

Repeat Infringer Policy
In accordance with the DMCA and EU law, Far Horizons OÜ maintains a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. We track infringement notifications and, where a user or data source is the subject of multiple valid complaints:
- First offence: The infringing content is removed and the user is notified.
- Second offence: The infringing content is removed, the user is warned that further violations may result in account termination.
- Third and subsequent offences: We may suspend or terminate the user’s account and delist all associated content.
We apply this policy in a balanced and proportionate manner, taking into account the nature of the infringement, whether counter-notifications were filed, and any mitigating circumstances.

Applicable Law
This Copyright Policy is governed by the laws of the Republic of Estonia and, where applicable, EU Directive 2001/29/EC (the InfoSoc Directive) and EU Directive 2019/790 (the Digital Single Market Directive). References to the DMCA are included because the DMCA framework is widely recognised and provides a well-understood procedure; compliance with the DMCA notification format is sufficient to satisfy our requirements under Estonian and EU law.
